Consider a memorandum/resolution authorizing a City/Owner Agreement in the amount of $100,000 for the installation of a traffic signal and associated improvements located at the intersection of SH-201/Clear Creek Road and Golden Gate Drive.

SUBJECT:                     Authorize City cost participation in the amount of $100,000 for the installation of a traffic signal and associated improvements located at the intersection of SH-201/Clear Creek Road and Golden Gate Drive                    

 

BACKGROUND AND FINDINGS:

 

A traffic signal warrant study was completed for the intersection of SH-201/Clear Creek Road and Golden Gate Drive.  Results indicated that a traffic signal is warranted due to existing traffic volumes. The developer of adjacent McGregor Estates development, JOF Developers, Inc., has submitted and obtained final approval for the design and construction of a traffic signal at the SH-201/Clear Creek Road and Golden Gate Drive intersection from the Texas Department of Transportation and City of Killeen. The intersection improvements and signal installation are currently under construction and soon to be fully functional. City staff has been inspecting the ongoing construction work. City will complete tasks related to signal timing plan and synchronization of this new signal with the two closest signals located at the intersection of SH-201 and FM 3470 and SH-201 and Mohawk Drive. The city will manage and maintain the signal operations in accordance with our Traffic Signal Maintenance Agreement with Texas Department of Transportation (TxDOT).  An addendum to the maintenance agreement will be executed upon final completion of the traffic signal to allow for the City to receive reimbursements for maintenance and operation of the signal.

 

Section 26-85 of the Killeen Code of Ordinances describes the process wherein the City may enter into an agreement with a developer to construct public improvements related to land development. Under such an agreement, the developer constructs the improvements and the City participates in project costs. The City has previously identified the need to participate in the construction of the traffic signal and associated intersection improvements to be located on SH-201/ Clear Creek Road and Golden Gate Drive intersection which will serve current and future areas of development along SH-201.  The total cost of the traffic signal and associated improvements at the intersection are $420,125.  The developer originally requested $126,037.50 or 30% of total project costs in participation from the City.  This is in compliance with the City Code of Ordinances and Texas Local Government Code which allow cost participation by a municipality at a level not to exceed thirty (30) percent of the total project cost.  However, the developer has agreed that the City's contribution will not exceed $100,000 or 23.8% of the total project cost.  This is the amount that the City had budgeted in anticipation of the project.

 

THE ALTERNATIVES CONSIDERED:

 

Alternatives are-

 

1.                     Do not approve the City/Owner Agreement for City’s financial contribution.

 

2.                     Approve the City/Owner Agreement and authorize the City Manager to execute the agreement for City’s financial contribution.

 

Which alternative is recommended? Why?

 

Existing traffic warrants the signal installation at the discussed intersection.  The developer has proposed to fund a portion of the signal and intersection improvements, which is not required.  The developer's offer to share the cost of the signal is a benefit to the City when otherwise the City would have been responsible for the full project costs.  The development will benefit from improved traffic conditions upon the completion of the development.

Entering into the City/Owner Agreement conforms to all State and City purchasing policies.

RECOMMENDATION:

 

Staff recommends that the City Council approve the City/Owner Agreement and authorize the City Manager or his designee to enter into the cost participation arrangement in the amount of $100,000 for the installation of a traffic signal and associated intersection improvements located at the intersection of SH-201/Clear Creek Road and Golden Gate Drive.
