SUBJECT: Operating Authority Amendment Request from Express Cab
BACKGROUND AND FINDINGS:
Chapter 29, City of Killeen Code of Ordinances, provides the manner by which an operating authority is granted and how it can be amended. An operating authority is the written authority granted by city council to provide ground transportation services in the City, which includes taxicab services. Express Cab’s operating authority was approved by city council in March 2019 and will expire in March 2024. To amend an operating authority, a holder must submit a written request to the city secretary describing in detail the proposed amendment. Any amendment must be approved by the city council.
The city secretary has received a letter from Misty McClellan, owner of Express Cab, requesting to amend the operating authority with the City of Killeen by changing the business name of Express Cab to Longhorn Taxi. Express Cab is owned by Misty McClellan and has been operating in Killeen since 2007 without incident.
THE ALTERNATIVES CONSIDERED:
Grant the amendment to the operating authority allowing the applicant to continue providing taxicab services to the citizens of Killeen, under a new business name, or do not grant the amendment to the operating authority.
Which alternative is recommended? Why?
Staff recommends the city council grant the amendment to the operating authority changing the business name from Express Cab to Longhorn Taxi. The written amendment request does conform to the City’s Code of Ordinances.
