SUBJECT:                     Memorandum of Understanding for Chaparral Road                     

 

BACKGROUND AND FINDINGS:

 

Chaparral Road is within the jurisdiction of Bell County, City of Killeen (COK), and City of Harker Heights (COHH).  The street is approximately 6.64 miles along the centerline and 13.28 miles along the frontage extending from SH 195 to FM 3481.  8.07 miles of frontage are located within the County jurisdiction, 4.85 miles of frontage are located within the City of Killeen jurisdiction, and 0.36 miles of frontage are located within the City of Harker Heights jurisdiction.  Killeen ISD is planning to develop an approximately 67.5 acre school site along Chaparral Road.

 

The County, COK, COHH, KISD are planning to work together to facilitate the design and construction of a five lane minor arterial roadway along the entirety of the road.  Therefore, a Memorandum of Understanding (MOU) has been prepared to establish the scope of the project and responsibilities of each of the parties as it relates to the project.  Each party needs to execute the MOU to make it effective and to begin design on the project.  Bell County Commissioners Court has already executed the MOU with other entities scheduled for approval.

 

The City of Killeen would provide $730,422 for design with Bell County providing $1,215,361 and the City of Harker Heights providing $54,217.  KISD will provide design and construction through a portion KISD property.  The City of Killeen will serve as the project manager for the project.  MOU constitutes only an expression of intent and shall have no legal or binding effect on the parties.  Any entity will have the ability to terminate this MOU in the future if funding is not available for construction.

 

THE ALTERNATIVES CONSIDERED:

 

1.                     Do not approve this Memorandum of Understanding and do not proceed forward with Chaparral Road Improvements.

2.                     Approve the resolution approving the Memorandum of Understanding and allow the City to continue to work with Bell County, the City of Harker Heights, and KISD on Chaparral Road Improvements.

Staff recommends that City Council approve the resolution approving the Memorandum of Understanding and allow the City to continue to work with Bell County, the City of Harker Heights, and KISD on Chaparral Road Improvements.

RECOMMENDATION:

 

Staff recommends that the City Council approve this resolution and authorize the City Manager or his designee to execute the Memorandum of Understanding for the Chaparral Road improvements.
