Attending:                     Mayor Pro Tem Jim Kilpatrick, Councilmembers, Butch Menking, Juan Rivera, Gregory Johnson, Debbie Nash-King and Steve Harris

 

Also attending were City Manager Ron Olson, City Attorney Kathryn Davis, City Secretary Lucy Aldrich, and Sergeant-at-Arms Gilman.

 

Absent:                     Councilmembers Shirley Fleming (Excused)

 

Mr. Jones gave the invocation, and Councilmember Nash-King led everyone in the Pledge of Allegiance.

 

Approval of Agenda

 

Motion was made by Mayor Pro Tem Kilpatrick to approve the agenda as written. Motion was seconded by Councilmember Rivera. The motion carried unanimously. 

 

Minutes

 

Motion was made by Councilmember Nash-King to approve the minutes of the January 29, 2019 Regular City Council Meeting.  Motion was seconded by Councilmember Menking.  Motion carried unanimously.

 

Resolutions

 

RS-19-015                     Consider a memorandum/resolution of support for housing tax credit applications to Texas Department of Housing & Community Affairs for Avanti Legacy West Elms, Edgewood Villas, Killeen Springs, Reserve at Bunny Trail, and Villas at Robinett, all affordable housing developments.

                     Staff Comments:  Leslie Hinkle, Executive Director of Community Development.

                     Ms. Hinkle provided an overview of the agenda item reviewing the history and background of the Housing Tax Credit Program.  Five applicants have submitted requests to be considered to participate in the Region 8 program.  Following publication of the agenda packet, one of the five applicants withdrew their application.  Applications for consideration include:  Villas at Robinett (southeast corner of Robinett and W. Elms Road), Edgewood Villas (northeast corner of N. 60th and Bills Road), Killeen Springs (Pennington and Foster), and Reserve at Bunny Trail (Bunny Trail).  Only one (1) project in Region 8 may receive funding in urban category.  Region 8 is composed of Killeen, Bryan, College Station, Temple, Waco, Harker Heights and Copperas Cove.  Staff recommends City Council consider all the project information, factors and impacts presented and issue resolutions of support with funding of $1,000 from the HOME program (loan) to all five (5) tax credit applications.

 

Motion was made by Councilmember Nash-King to approve RS-19-010 with a resolution of support of the Edgewood Villas project only.  Motion was seconded by Councilmember Menking.  Following discussion, Mayor Pro Tem Kilpatrick made an amended motion to approve RS-19-010 with a resolution of support with funding of $1,000 from the HOME program to the Villas at Robinett and the Edgewood Villas projects and resolutions of support with no objections to the Killeen Springs and the Reserve at Bunny Trail projects.  Councilmember Rivera seconded the amended motion.  The amended motion carried 5 to 1 with Councilmember Menking in opposition.  Mayor Segarra called for a vote on the main motion as amended.  Motion as amended carried unanimously.

 

RS-19-016                     Consider a memorandum/resolution awarding Bid No. 19-16 for the construction of the South Water Supply Project, Phase 1: Lower Pressure Plane Water Main to Gary W. Purser Construction Ltd. 

                     Staff Comments:  David Olson, Executive Director of Public Works.

Bell County Water Control and Improvements District No. 1 (WCID No. 1) is currently building a new water treatment plant at Stillhouse Hollow Lake along with a large transmission water main to deliver 10 MGD of treated water to the City of Killeen (City).  This project has an estimated completion date of Spring 2020.  The south water supply project, phase 1 is approximately 3,000 linear feet of 20-inch water line pipe along the South side of Chaparral Road to connect to the City’s water system.  On January 16, 2019, bids for construction of the SWS Phase 1:  Lower Pressure Plane Water Main were opened and read aloud.  Five (5) contractors submitted bids on this project.  Gary W. Purser Construction, Ltd. was the low bidder at $562,676.  Staff recommends that the City Council authorize the City Manager, or designee, to enter into an agreement with Gary W. Purser Construction, Ltd. for a contract to construct the South Water Supply Project, Phase 1: Lower Pressure Plane Water Main in the amount of $562,676 and further recommends that the City Manager, or designee, be expressly authorized to execute any and all changes to this contract within the amounts set by state and local law.

 

Motion was made by Mayor Pro Tem Kilpatrick to approve RS-19-016.  Motion was seconded by Councilmember Rivera.  Motion carried 4 to 2 with Councilmember Johnson and Councilmember Harris in opposition.

 

RS-19-017                     Consider a memorandum/resolution awarding Bid No. 19-10 for the security surveillance project on Robert Gray Army Airfield to Unified Services of Texas.

                     Staff Comments:  Matt Van Valkenburgh, Executive Director of Aviation.

                     This project is for the installation of security surveillance systems on Robert Gray Army Airfield (RGAAF).  It consists of closed-circuit television cameras, monitoring and recording equipment, data storage, and fiber for RGAAF and KFHRA.  Funding comes from the Defense Economic Adjustment Assistance Grant (DEAAG), US Army Garrison at Fort Hood, Bell County, local cities and Economic Development Corporations.  Requests for proposals were issued November 2018 with a submission date of December 21, 2018.  Two proposals were received.  With UST providing the best value and the breadth of experience with DEAAG projects and Fort Hood, staff recommends that City Council authorize the City Manager or designee to execute a construction contract with Unified Services of Texas in the amount of $4,008,816 as well as any and all change orders or supplemental agreements within the amounts set by state, federal, or local law.

 

Motion was made by Councilmember Rivera to approve RS-19-017.  Motion was seconded by Councilmember Johnson.  Motion carried unanimously.

 

 

Public Hearings

 

PH-18-039                     HOLD a public hearing and consider an ordinance requested by the Killeen Independent School District (KISD) (Case #Z18-25) to rezone approximately 67.506 acres out of the J.D. Allcorn Survey, Abstract No. 25, from “A” (Agricultural District) to “R-1” (Single-Family Residential District) for a future public school site.  The subject area is located northeast of the intersection of Chaparral Road and Cedar Ridge Circle, Killeen, Texas.

 

                     The City Secretary read the caption of the ordinance.

                     AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF KILLEEN BY CHANGING THE ZONING OF APPROXIMATELY 67.506 ACRES OUT OF THE J.D. ALLCORN SURVEY, ABSTRACT NO. 25, FROM “A” (AGRICULTURAL DISTRICT) TO “R-1” (SINGLE-FAMILY RESIDENTIAL DISTRICT) FOR A FUTURE PUBLIC SCHOOL SITE; PROVIDING FOR THE REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR AN EFFECTIVE DATE.

 

                     Staff comments:  Tony McIlwain, Assistant Director of Planning.

                     Mr. McIlwain reviewed the request submitted by the Killeen Independent School District.  Notification of the rezoning request was sent to one hundred and forty-two (142) surrounding property owners.  Staff has not received any objections.  By a vote of 7 to 0, the Planning and Zoning Commission recommends approval of the request. 

 

Mayor Segarra invited the applicant to speak.

 

                     With no one in the audience representing the applicant or the applicant themselves, Mayor Segarra moved on to the public hearing.

 

Mayor Segarra opened the public hearing.

 

                     Mellisa Brown, 6105 Melanie Drive, spoke against the request.

 

With no one else appearing, the public hearing was closed.

 

Motion was made by Councilmember Menking to approve PH-18-039.  Motion was seconded by Councilmember Rivera.  Motion carried unanimously.

 

Adjournment

 

With no further business, upon motion being made by Mayor Pro Tem Kilpatrick, seconded by Councilmember Nash-King, and unanimously approved, the meeting was adjourned at 5:44 p.m.
