SUBJECT: Reappointment of Presiding Municipal Court Judge
BACKGROUND AND FINDINGS:
The position of Presiding Municipal Judge is currently filled by Mr. Mark D. Kimball. Judge Kimball has served in this capacity since February 24, 2014. Charter authorizes the City Council to appoint the Presiding Municipal Judge for a four-year term.
THE ALTERNATIVES CONSIDERED:
Council can choose to reappoint Judge Mark D. Kimball to the position of Presiding Municipal Court Judge or advertise for the position to be filled.
Which alternative is recommended? Why?
Staff recommends that the Council reappointment Judge Mark D. Kimball to the position of Presiding Municipal Court Judge for a four-year term, based on the majority consensus reached at the Council workshop held on February 6, 2018.
CONFORMITY TO CITY POLICY:
Texas Government Code sec. 30.00006(b) provides that the governing body shall by ordinance appoint its municipal judge and sec. 30.00006(d) states that the governing body shall provide by ordinance for the term of office of its municipal judges. The term must be for a definite term of two or four years and Charter requires the City Council to appoint the Presiding Municipal Judge for a four-year term.
