SUBJECT: Meet and Confer Agreement with Killeen Police Employee Association Fraternal Order of Police Lodge 32

BACKGROUND AND FINDINGS:

In May 2022, City Council ratified a Meet and Confer Agreement with the Killeen Police Employee Association (KPEA) Fraternal Order of Police (FOP) Lodge 32. In September 2023, City Council ratified revisions to the Meet and Confer Agreement. Applicable statutes and local orders, ordinances, and civil service rules apply to an issue not governed by the Meet and Confer Agreement. The main issue addressed in the agreement is the promotional process.

Pursuant to the terms of the agreement, city staff began meeting with representatives of the KPEA-FOP in June 2024 to discuss updates to the agreement. The proposed changes include updating the term of the agreement to a two year term, providing for a lateral hire process that will allow the City to hire experienced officers through a more efficient process, providing for positive discipline, allowing supervisor intervention for minor violations rather than formal discipline, eliminating geographical distance requirements for KPD officers, and allowing supervisors to take assigned vehicles home if the officer lives within 30 miles of the City limits.

The current agreement will be in effect until September 30, 2024, unless extended for another six months or a new agreement is reached.

In order for a Meet and Confer agreement to be enforceable and binding, Texas Local Government Code 142 requires that the City Council and the police association ratify the agreement. KPEA-FOP 32 conducted an election and approved the agreement by a vote of 165 to 14.
