BACKGROUND INFORMATION

BELLCO Investment Group, Inc. submits this request for the abandonment of a 20' alley that is located between N. Gray St. and N. 4th St., and 117 and 113 N. Gray St., Killeen, Texas, with reservation of a utility easement in place of the alley.

DISCUSSION/CONCLUSION

BELLCO Investments Group, Inc. owns property located at 103 and 111 N. Gray Street, just north of Veterans Memorial Boulevard (Bus. Hwy. 190).  They are petitioning the City Council to abandon the alley that bisects their property.  Staff sent out notices to three property owners with land adjacent to the alley, various City Departments and franchise utility providers.  Both Oncor Electric and Atmos Energy informed staff that they have existing utility infrastructure within the 20' alley.  Additionally, the Public Works Department requested that an easement be put in place of the alley, if the alley is abandoned. Staff has provided a quitclaim deed that reserves the City's and other franchise utility providers' access to the property via a utility easement. Staff has received a response from Oncor Electric consenting to the language contained within the quitclaim deed. Staff has not received a response from any affected property owners, but will update the City Council accordingly on the matter.
