SUBJECT: Establish a public hearing date of November 17, 2026, regarding an update and amendment of the City’s Water and Wastewater Impact Fees and associated Land Use Assumptions and Capital Improvement Plan

BACKGROUND AND FINDINGS:

On April 13, 2021, Killeen’s City Council adopted Ordinance 21-015, which implemented water and wastewater impact fees in the City effective April 14, 2021. With City Council’s adoption of the 2025 Water and Wastewater Master Plan on April 1, 2025, an update to the 2021 impact fees was needed to incorporate a new capital improvements plan and a current pricing structure. With City Council’s approval on July 15, 2025, Kimley-Horn was hired to update the City’s water and wastewater impact fees.

In accordance with Texas Local Government Code Chapter 395, Section 395.053, Killeen’s City Council is required to adopt an order to establish a Public Hearing on November 17, 2026, for an update and amendment to the City’s water and wastewater impact fees and associated land use assumptions and capital improvement plan. This action is taking place after receiving updates to the land use assumptions and the capital improvement plan which were made available on the city website. This action follows a very stringent timeline established by the Texas Local Government Code for updating and amending impact fees.

Kimley-Horn’s water and wastewater impact fee update study and the independent financial audit of the water and wastewater impact fee fund for the period June 1, 2021, through September 30, 2025, are attached to this memo for review.
