SUBJECT: Authorize the acceptance of two tracts of land from Clear Creek Commercial, Ltd. Related to the Pump Station No. 7 Upgrade Project.

BACKGROUND AND FINDINGS:

The 2019 Water and Wastewater Master Plan includes a project for the upgrade of Pump Station No. 7 which is located approximately 800-feet east of the Stan Schlueter Loop and Clear Creek Road intersection. KSA Engineers, Inc., the design firm for this project, recommends the acquisition of a 40'x70' lot adjacent to the north property line of the existing pump station property. This adjacent lot will be the site for the building of a 100,000-gallon water storage tank and other appurtenances.

Clear Creek Commercial, Ltd. proposes to donate the needed lot with the stipulations that 1) a Clear Creek Commercial logo is placed on the new tank and 2) the City accepts the donation of a 0.906 acre detention pond parcel at 4200 Benjamin Drive, approximately 1,300-feet northwest of Pump Station No. 7. The detention pond parcel can be used for a future pocket park which is greatly needed in this part of the City. Staff estimates an annual cost of $4,700 to maintain the parcel at 4200 Benjamin Drive.

THE ALTERNATIVES CONSIDERED:

(1) Do not authorize the acceptance of the two tracts from Clear Creek Commercial related to the Pump Station No. 7 Upgrade Project.
(2) Negotiate the purchase of the lot proposed for the pump station upgrade.
(3) Find another suitable property to purchase.
(4) Authorize the acceptance of two tracts from Clear Creek Commercial related to the Pump Station No. 7 Upgrade Project.
