BACKGROUND AND FINDINGS:
On December 12, 2023, City Council approved entering into an interlocal agreement with the General Land Office and Veterans Land Board allow the City of Killeen to assume responsibility for cemetery management and operation services to include absorbing the current employees into the City of Killeen. Texas Government Code, Chapter 791, authorizes local governments to contract for governmental functions. At that time the Texas State Veterans Cemetery was managed by the General Land Office and Veterans Land Board using contract employees. The Board retained ownership and responsibility for all of the Veterans’ Cemetery assets including, but not limited to, all buildings, real property, capital expenditures, an any other piece of equipment or asset the cost of which is borne by the Board.
City of Killeen staff, the Veterans Land Board, and the General Land Office discussed proposed amendments to the existing contract and the following changes were agreeable to both parties:
• Section 1.02 to refer to the updated Management and Operations Fee; Provider’s Budget (Attachment D-1) as well as the Updated Cemetery Inspections Checklist (Attachment E-1)
• Revise the surplus clause for surplus to go to general fund
• Revise the end term date of the contract to terminate on September 30, 2025, with option to renew for three additional one-year periods
• Correct a few typos in Attachment D-1

The City of Killeen’s Financial Management Policy recognizes City Council’s ability to approve interlocal agreements authorized by Texas Government Code, Chapter 791.

Revenue of $1,969,991 for FY25 with a 5% escalator each additional year the contract is extended.

This a recurring revenue upon renewal.

Yes, the revenue and expenditure budgets for the Central Texas State Veteran’s Cemetery Fund is included in the FY 2025 Adopted Budget in the amount of $1,969,991.

RECOMMENDATION:
City Council authorize the City Manager or his designee to execute an amendment to the Interlocal Agreement with the General Land Office and Veterans Land Board for the City of Killeen to assume responsibility for Cemetery Management and Operation Services for the Texas State Veterans Cemetery in Killeen, Texas.
