SUBJECT: Authorize the City Manager to execute an updated Traffic Signal Maintenance Agreement with the Texas Department of Transportation and terminate the existing Agreement
BACKGROUND AND FINDINGS:
In 1978, the City of Killeen and the State Department of Highways and Public Transportation entered into a maintenance agreement to establish mutual rights and duties of the City and the Department with regard to the installation and maintenance of State Highways within the corporate limits of Killeen.
In 1991 (CCMR 91-56 - update population), 1992 (CCMR 92-96 - addition of 5 signals), 1997 (CCMR 97-52R - amendment of street names), 2000 (CCMR 00-134R - addition of intersection), 2005 (Supplemental Agreement # 1), 2007 (CCMR 07-213R - Update of language), 2014 (CCMR 14-016R - Update of language - Red-light cameras), and 2017 (Supplemental Agreement # 2), updates were completed.
The Texas Department of Transportation (TxDOT) has requested that the City of Killeen terminate the current agreement and supplemental agreements under Contract No. 395M5001 and simultaneously execute a new Traffic Signal Maintenance Agreement that would include any and all applicable revisions to date.
The new Agreement for the Installation and Reimbursement for the Operation and Maintenance of Traffic Signals within a Municipality would fall under the same contract No. 395M5001. This is a standard TxDOT contract, by which the City performs certain responsibilities. The City will be reimbursed for the services as provided in the exhibits.
THE ALTERNATIVES CONSIDERED:
The following alternatives were considered with this item:
1) Leave the contract as is and continue to maintain signals without proper reimbursement. Not all intersections are currently included.
2) Authorize the termination of the original contract and simultaneously execute a new Agreement for the Installation and Reimbursement for the Operation and Maintenance of Traffic Signals.

City staff recommends Alternative 2, terminate the current agreement and supplemental agreements under Contract No. 395M5001 and simultaneously execute a new Traffic Signal Maintenance Agreement that would include any and all revisions to date.

There is no fiscal impact beyond those maintenance funds currently budgeted and set for reimbursement by TxDOT.

RECOMMENDATION:
City staff recommends that City Council authorize the City Manager, or designee to terminate the current agreement and supplemental agreements under Contract No. 395M5001 and simultaneously execute a new Traffic Signal Maintenance Agreement that includes all revisions to date. City staff further recommends that City Council authorize the City Manager, or designee, to execute any and all changes within the amounts set by State and Local law.
