SUBJECT: Ordinance proposing amendment to Chapter 31 of the Killeen Code of Ordinances
BACKGROUND AND FINDINGS:
In August 2020, the City Council adopted Ordinance No. 20-038, which moved all landscaping regulations from Chapter 8 (Building and Construction Regulation) to Chapter 31 (Zoning). The approved ordinance inadvertently left out the section regarding landscaping standards for nonresidential, multiple apartment complex development, and commercial use lots and parcels.
The intent of the proposed ordinance is to reinstate those standards. The proposed ordinance replaces the language that was removed verbatim. No changes to the old landscaping standards for nonresidential, multiple apartment complex development, and commercial use lots and parcels are proposed at this time. However, future ordinance changes will be considered when the proposed Unified Development Code is developed.
The proposed ordinance also includes language amending the list or permitted fencing materials to clarify that R-Panel and U-Panel metal fences are permitted, provided they are coated and capped at the top.
THE ALTERNATIVES CONSIDERED:
The City Council has three (3) alternatives. The Council may:
§ Disapprove the ordinance;
§ Approve the ordinance with modifications; or
§ Approve the ordinance as presented.

Staff recommends approval of the ordinance as presented.
CONFORMITY TO CITY POLICY:
It is the City’s policy to comply with state law. This ordinance, if approved by City Council fulfills this requirement.

RECOMMENDATION:
At their regular meeting on September 19, 2022, the Planning and Zoning Commission recommended approval of the ordinance by a vote of 6 to 0.
