Consider a memorandum/resolution authorizing the City Manager to enter into agreements with the Texas Department of Public Safety and the Texas Department of Transportation concerning the installation and operation of an automatic license plate reader system.

BACKGROUND AND FINDINGS:

 

On January 7, 2025, City Council approved the application and acceptance of the SB 224 Catalytic Converter Grant as administered by the Texas Motor Vehicle Crime Prevention Authority (MVCPA), a division of TxDOT.  On January 23, 2025, we were informed that the City of Killeen was awarded $400,000 in grant funding.  The grant requires a $100,000 match in city funds.  On March 4, 2025, City Council approved the purchase of a Flock Safety Camera System utilizing those funds.

The Killeen Police Department has now entered the implementation phase of this project.  The cameras will be placed utilizing a data-based approach that factors in current and historical crime trends to maximize their effectiveness.  Prior to installation and connection to the Texas Crime Information Center’s (TCIC) database, the city must enter into agreements with the Texas Department of Public Safety (DPS). 

 

The first is a MOU regarding access to the TCIC stolen license plate and stolen vehicle databases. The second is the License Plate Reader (LPR) Agreement.  It provides access to the shared LPR database and identifies rules including access, retention, and security. 

 

Many of the camera locations are located in the Texas Department of Transportation (TxDOT) right-of-way.  Before proceeding with those locations, the city must enter into a multi-use agreement with TxDOT.  The agreement will give the city and its vendor access to the areas of the right-of-way for installation and maintenance of the cameras. 

 

There are no additional costs related to the agreement.  KPD has policies in place to ensure compliance with the stipulations within these agreements.

RECOMMENDATION:

 

The city staff recommends that the City Manager or his designee be authorized to enter into the Memorandum of Understanding Regarding Stolen Vehicles and License Plates and the License Plate Reader User Agreement with the Texas Department of Public Safety, as well as the Multiple-Use Agreement with the Texas Department of Transportation as presented.
