SUBJECT:                     Approving a buyboard cooperative agreement with Heartland Parks and Recreation, LLC. for design/construction for trails and sidewalks for four (4) parks.                     

 

BACKGROUND AND FINDINGS:

 

The City of Killeen was awarded ARPA funds for parks projects.  Parks and Recreation is seeking approval for a buyboard cooperative agreement with Heartland Parks and Recreation, LLC. in an amount not to exceed $1,172,771.  The funds will be used to design and construct sidewalks and trails for Phyllis Park, Conder Park, Stewart Park, and Long Branch Park West.  ADA allowances are included in this amount for known challenges that might develop in the design.

 

If approved, Heartland Parks and Recreation. LLC will take approximately 45 days for site analysis and design, and all trail work will be completed 90 days from the start of construction, making the conservative timeline for the project to be completed by fall.

 

Staff believes that these sidewalks and trails will provide a place where people can be physically active to reduce stress, give more access to green environments, and provide a safe and easy place for people to walk, bike, wheelchair roll, and do other physical activities.

CONFORMITY TO CITY POLICY:

 

The construction and design of sidewalks and trails will be done through a buyboard cooperative agreement with Heartland Parks and Recreation, LLC.  Services made through a cooperative contract are exempt from the competitive bidding process as stated in Texas Local Government Code Section 271-102, subchapter F; a local government that purchases goods or services under this subchapter satisfies any state law requiring the local government to seek competitive bids for the purchases of goods or services.

RECOMMENDATION:

 

Staff recommends City Council approve the buyboard cooperative agreement with Heartland Parks and Recreation, LLC for the final design and construction of sidewalks and trails within and around Conder, Phyllis, Long Branch West, and Stewart Parks in the amount of $1,172,771 and that the City Manager, or his designee, is expressly authorized to execute any and all change orders within the amounts set by State and Local Law.
