SUBJECT: Agreement for the Construction, Maintenance and Operation of Continuous Highway Lighting Systems with the Texas Department of Transportation
BACKGROUND AND FINDINGS:
The Texas Department of Transportation (TxDOT) has requested that the City of Killeen enter into an agreement for construction, maintenance, and operation of a continuous highway lighting system within the City of Killeen along the Interstate 14 corridor from SS 172 (western City limits) to just east of Jasper Drive.
Upon approval of this agreement, TxDOT will prepare, or provide for, the plans and specifications, advertise for bids, award the construction contract, and supervise construction of the project. TxDOT will also submit plans and specifications of the proposed work to the City and will secure the City’s consent to construct the lighting system prior to awarding the contract. All costs associated with the construction of the lighting system will borne by TxDOT and the lighting system will remain property of the State of Texas. This project is set to be awarded for construction in June 2025, with an estimated construction start date to begin in February 2026; as there is a 180-day delay start for materials.
It is estimated that the lighting system would be turned over to the City for maintenance approximately October/November 2026. Maintenance funds will need to be allocated beginning in the FY 2027 budget. It would be agreed upon that the City will furnish, at its expense, the electrical energy required for proper operation of the lighting system, will maintain, and operate the lighting system in an efficient and sightly condition without any cost to the State. The City will assume these operations and maintenance costs upon written notification from the State that the lighting system is complete and accepted. This agreement will remain in force for a period of two years from the date responsibilities are assumed by the City and will automatically renew for two-year periods unless modified by mutual agreement by both parties. This agreement can be terminated sixty days after filing of written notice by either party.

RECOMMENDATION:
Authorize the City Manager or designee, to execute the Agreement for Construction, Maintenance, and Operation of Continuous Highway Lighting Systems Within a Municipality with the Texas Department of Transportation for the operation and maintenance of high mast lighting along the I-14 corridor.
