SUBJECT: Authorize the execution of a contract amendment with Pape Dawson, for the Stagecoach Roadway Replacement Project in the amount of $355,360.38
BACKGROUND AND FINDINGS:
The Stagecoach Roadway Replacement Project was originally completed in 2018. However, during and immediately after its completion, the roadway condition failed. The City pursued legal actions against the contractor for the project. That suit was recently settled. As part of the negotiations, the city started the design of the construction plans needed to replace the roadway.
On March 21, 2023, the City Council approved a contract with Pape Dawson Engineers to provide the necessary design. The contract only covered the design portion of the project. Due to funding for the project, it was decided to break the entire project length, which starts at State Highway 195 and ends at East Trimmier Road, into phases based on available funding. The first plans received by the consultant were for Phase 1 which starts at W.S. Young and extends to the East Trimmier Road. The remaining phases will be determined as funding becomes available through the street fee.
On April 1st the city council approved the construction contract for the Stagecoach Reconstruction Phase 1 to JHL Construction. This contract amendment includes the needed work to create the bid documents for each remaining phase. The original contract only included one set of plans and did not account for multiple phases. In addition, the amendment includes needed construction management for the construction of Phase 1 and needed geotechnical field testing to ensure if lime is needed to be installed in the native soils and, if so, to what extent.
Staff reviewed and negotiated the proposal with Pape Dawson Engineers, in the amount of $355,360.38 to perform the needed services and found the amount to be reasonable.

Pursuant to Texas Local Government Code (TLGC), section 252.022(a)(4), this item is exempt from the competitive bidding requirements, as it is an agreement for the procurement of processional services.

What is the amount of the revenue/expenditure in the current fiscal year? For future years?
The fee for services under this agreement for the current fiscal year is $355,360.38.
Is this a one-time or recurring revenue/expenditure?
This is a one-time expenditure.
Is this revenue/expenditure budgeted?
The project is partially funded in the 2022 Bond and Governmental CIP Funds. The remaining budget will be appropriated on the mid-year amendment going to City Council on April 15, 2025.
If not, where will the money come from?
Approval of the mid-year budget amendment will fully fund the project.
Is there a sufficient amount in the budgeted line-item for this revenue/expenditure?
Funds are currently budgeted in the Governmental CIP Fund (300-56201-900-400-923012) in the amount of $418,498 and the 2022 Bond Fund (305-56201-900-400-923012) in the amount of $2,104,786. Additional revenue will be appropriated in the mid-year budget amendment to cover the contract as follows: $1,250,000 in the Governmental CIP Fund (300-56201-900-400-923012) and fund balance will be appropriated in the Street Maintenance Fund (225-56201-900-400-923012) in the amount of $4,783,619.
RECOMMENDATION:
Staff recommends that the City Council authorize the City Manager or his designee to execute the contract amendment with Pape Dawson, for the Stagecoach Roadway Replacement Project, in the amount of $355,360.38.
