SUBJECT:                     Authorize approval of a professional services agreement with 120Water, Inc. for lead and copper inventory and testing services.                     

 

BACKGROUND AND FINDINGS:

 

120Water, Inc. submitted a quote in the amount of $59,247.42 for the Lead and Copper Inventory Services. This will be the second year that the City of Killeen will be working with 120Water to meet the requirements of the Environmental Protection Agency’s (EPA) Lead and Copper Rule. Last year, staff collaborated with 120Water to complete the Lead Service Line Inventory (LSLI) and successfully submitted it prior to the EPA's deadline. Through this process, staff were able to identify all active service lines and verify that the City of Killeen does not have any lead service lines within the system.

Under the scope of the proposed agreement, along with maintaining the City’s LSLI, 120Water will also conduct lead and copper sampling and testing, perform required water sampling at school facilities, and manage public communication to include the distribution of notification letters to residents who have been determined to still have lead or copper service lines. The EPA requires that notification letters be mailed out in November each year! These services ensure that the City of Killeen remains in compliance with the EPA’s Lead and Copper Rule, while continuing to protect public health and maintain transparency with the community.

City staff has been pleased with 120Water’s services in FY 2024. Funding for this service is allocated in the Fiscal Year 2025 Water Distribution Budget. A letter of agreement for 120Water’s Lead and Copper inventory services has been proposed.

Pursuant to Texas Local Government Code (TLGC), section 252.022(a)(4), this item is exempt from the competitive bidding requirements, as it is an agreement for the procurement of processional services.

The total expenditures for FY 2025 will be $53,871.74 and $5,375.68 in FY 2026.
