BACKGROUND AND FINDINGS:
The FY 2022 Capital Improvement Plan includes the Emergency Operations Complex (EOC) project as a funded project for design and construction with $11.9 million in ARPA funding. On May 3, 2022, the City Council approved a motion of direction moving the FY 2021 excess balance from the General fund to the Governmental CIP fund allowing construction of a new Fire Station #4 (the city’s ninth fire station). On June 14, 2022, the City Council approved the land purchase from the Killeen Independent School District to accommodate both the EOC project and Fire Station #4.
The project includes the design and construction support of a multi-use facility that includes combined fire and paramedic response operations, fire training, fire support services, Emergency Operations Center offices, training classrooms, supply rooms, and a maintenance building.
Martinez Architects provided professional services for design and bid support. Staff then solicited bids for construction of the facility. All received bids were opened on January 17, 2024, and were read aloud through zoom online video conferencing and are noted below.

There were two contractors that submitted bids for the project. In review of the bids, it was found that only one was a complete bid that addressed the requirements. The qualified bidder based on the bid scoring selection was MW Builders. The bid received included costs for the base construction that included the Fire Station/EOC Building and all site work, Alternate 1 that includes the support services building, and Alternate 2 that included the Fire Training Structures. In review of available budget and immediate needs, it was determined to make the recommendation to award the bid for the base bid and Alternate 1: Support Building in the total amount of $22,184,000.00. Alternate 2: Fire Training Structures will be reviewed and bid once additional funding can be made available.
THE ALTERNATIVES CONSIDERED:
1. Reject all received bids and do not move forward with the construction of the Fire Station No. 4/EOC Training Facility.
2. Award Bid 24-19 to MW Builders for the construction of the Fire Station #4/EOC/Training Facility Project - Base Bid ONLY in the amount of $17,197,000
3. Award Bid 24-19 to MW Builders for the construction of the Fire Station #4/EOC/Training Facility Project - Base Bid, Additional Alternate No. 1 AND Additional Alternate No. 2 in the amount of $23,818,000
4. Award Bid 24-19 to MW Builders for the construction of the Fire Station No. 4/ EOC/ Training Facility Project - Base Bid and Additional Alternate No. 1 in the amount of $22,184,000.00.
Which alternative is recommended? Why?
Alternative 4 is recommended because:
a. MW Builders is the lowest responsible bidder that submitted a complete bid package.
b. Martinez Architects, the design engineering firm on this project, reviewed and recommended the contract be awarded to MW Builders in the amount of $22,184,000.00 for the Base Bid and Additional Alternate No. 1.
CONFORMITY TO CITY POLICY:
The project conforms to all State and City purchasing policies.

This is a one-time expenditure.
Is this revenue/expenditure budgeted?
Yes, $11,048,894 of ARPA funding is available in the Governmental CIP Fund account 349-8970-493.69-03 and $5,203,434 is available in the Governmental CIP fund account 349-8970-493.69-03 from the FY 2021 excess fund balance. Upon City Council’s approval of the mid-year budget amendment in April, Staff recommends appropriating $1,900,000 from the Governmental CIP Fund unassigned fund balance and the remaining $4,032,863 is recommended to be appropriated from the FY 2023 excess fund balance above 22% after the delivery of the FY 2023 audit in March.

RECOMMENDATION:
Staff recommends that the City Council award Bid 24-19, Fire Station No. 4 EOC Training Facility Project to MW Builders in the amount of $22,184,000.00 for the Base Bid and Alternate No. 1, authorize the City Manager or his designee to enter a contract with MW Builders, and authorize the City Manager to execute any and all change orders.
